I'd say that's probably true. But even in a case where someone is licensed, you would have a very hard time trying to sue someone for their opinion. It's rare but it can happen though. Malpractice cases do happen against doctors. There are times when patients go to the ER and complain of chest pains and the doctor sends the guy home with an incorrect diagnosis of heartburn. And then the guy ends up dying of a heart attack. In other words, the doctors educated opinion was that of heartburn when really it was the beginning stages of cardiac arrest. I am unsure whether or not malpractice is fraud though. I suppose it could be in some cases though. Like in cases where a doctor messes up numerous plastic surgeries on patients.An expert's statement of opinion may be subject to a claim of fraud? True or False?
it could be fraud if they use misrepresentation information to support their opinions
